Terms & Conditions

The following is the entire Acceptable User Policy (“AUP”) agreement between ROBICO WEB SOLUTIONS PTY LTD (“ROBICO”) and the personal or corporate account holder (“YOU/YOUR/Customer”). ROBICO provides World Wide Web Hosting, Marketing, and Development. ROBICO has certain legal and ethical responsibilities consisting with the use of its servers and equipment involved in these services. ROBICO general policy is to act as a provider of Internet presence. ROBICO reserves the rights to suspend or cancel a customer’s access to any or all services provided by ROBICO when we decide that the account has been inappropriately used or violates our terms and conditions shown below without warning or prior notice. No refunds of fees paid will be made if account termination is due to violation of the terms outlined below.

Payment Information

You agree to supply appropriate payment for the services received from ROBICO, in advance of the time period during which such services are provided. You agree that until and unless you notify ROBICO of your desire to cancel any or all services received, those services will be billed on a recurring basis. This includes when accounts are suspended. Cancellations must be done in writing via the cancellation form provided. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you in writing (typically email) that your account has been canceled. ROBICO provides a 10 day grace period from the time the invoice is generated and when it must be paid. Any invoice that is outstanding for 10 days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full. The $10 late fee is applied in addition to whatever else is owed to ROBICO for services rendered. Access to the account will not be restored until payment has been received. Invoices that have been paid more than once with multiple Paypal Subscriptions can only be added as credit towards the account and cannot be refunded via Paypal.

Price Change

The amount you pay for your services will never increase from the date of purchase as long as you don’t upgrade or downgrade your service. We reserve the right to change prices listed on robicowebsolutions.com, and the right to increase the amount of resources given to plans at any time.

Special Offers

Discounts and special offers from ROBICO are reserved for first-time customers only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have signed up using a particular domain, you may not resign up for that domain using another coupon at a later date. Different discounts and special offers may not be combined together.

Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount, ROBICO reserves the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of ROBICO is strictly prohibited. ROBICO will strongly react to any use or attempted use of an Internet account or computer without the owner’s authorization. Such attempts include “Internet scamming” (tricking other people into releasing their passwords), password theft, security hole scanning, etc. Any unauthorized use of accounts or computers by you, whether or not the attacked account or computer belongs to ROBICO, will result in action against you. Possible actions include warnings, account suspension or cancelation, as well as civil or criminal legal action, depending on the seriousness of the attack. You may not run IRC, bots or clients on shared servers. Unacceptable uses also include, but are NOT limited to: Bulk emailing, unsolicited emailing, newsgroup spamming, pornographic content, illegal content, copyright infringement, trademark infringement, warez sites (including links to/from), cracks, software serial numbers, proxy-relaying, link farming (the act of or by use of scripts), link grinding, link-only sites, spamdexing, FFA (Free-For-All) and/or anything else determined by ROBICO to be unacceptable use of our services including abuse of server resources. You are responsible for and should evaluate your web-based applications and scripts on a regular basis to ensure their security and orderliness.

Accounts may also be terminated if it includes the following content or have links to the following content: Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity; promoting or providing instructional information about illegal activities; promoting physical harm or injury against any group or individual; displaying material containing obscene nudity or pornographic material (not applicable to managed dedicated servers); displaying material that exploits children under 18-years of age; acts of copyright infringement including offering pirated computer programs or links to such programs; information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities.

Spam Policy

Unsolicited commercial advertisements (“SPAM”) are not allowed in e-mail, and will likely result in account cancelation. ROBICO takes a zero-tolerance approach to SPAM originating from its servers or for spam advertising of domains hosted within our network. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated. ROBICO reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion. ROBICO reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of ROBICO.

Technical Support Boundaries

ROBICO provides technical support for you that encompasses within our area of expertise only. Such expertise includes assistance, troubleshooting, and debugging of our cPanel control panel interface, servers within our immediate responsibility and any other hosting related issues. However, in under no circumstances is ROBICO neither obligated to help you in the installations of new application modules, templates and/or programming languages, nor in providing assistance for any errors produced by any applications that have been modified by you previously.

Backups and Data Loss

Your use of this service is at your sole risk. ROBICO is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on ROBICO servers.

Cancellation of Service

ROBICO reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice. Any abuse of our staff will result in the suspension or termination of your services. All of ROBICO’s plans are backed by a 30-day money back guarantee. If you are not completely satisfied with our services or support within the first 30 days of your contract, you will be given a full refund of the contract amount excluding a cancellation fee. Violations of the Terms of Service will waive the refund policy.

Indemnification

You agree that you shall defend, indemnify, save and hold ROBICO harmless from any and all demands, liabilities, losses costs and claims, including reasonable attorney’s fees asserted against ROBICO, its agents, its customers officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you, your agents, employees or assigns. You agree to defend, indemnify and hold harmless ROBICO against liabilities arising out of: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with ROBICO’S server. (2) any material supplied by the customer infringing or allegedly infringing on the proprietary rights of a third party (3) copyright infringement and (4) any defective products sold to customer from ROBICO’S server.

Disclaimer

ROBICO will not be responsible for any damages your busiiness may suffer. ROBICO makes no warranties of any kind, expressed or implied for services we provide. ROBICO disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong deliveries, and any and all service interruptions caused by ROBICO and its employees. ROBICO reserves the right to revise its policies at any time.
